TERMS AND CONDITIONS

The Terms and Conditions govern all bookings with Waterside Developments("the Company").  Any booking made or order placed by you, whether through the Company's website or otherwise, shall be deemed an agreement by you to rent the relevant accommodation subject to these terms and conditions.  All bookings through our Company and all matters arising from them are subject to Cyprus law and to the exclusive jurisdiction of the courts of Cyprus.  The person who makes the booking accepts these conditions on behalf of all members of the party and is responsible for all payment due from the party. Booking services with the company are currently only available to persons 18 years or older.  By making a booking you warrant and confirm to us that you have read these Terms and Conditions and agree to comply with them.

The company is dependent upon the information supplied to us by advertisers and property owners, we must make the following disclaimers:-

The accuracy of the information of the company is the sole responsibility of the advertiser/owner of the property. The company does not assume any responsibility for the accuracy of this information.

  1. The company gives no confirmation or guarantee of the description or the standard of the properties in the advertisements published in it web pages.

  2. The company and advertisers are not responsible for any typographical errors in the information supplied.

  3. Rates and conditions are subject to change without notice.
Liability:

The company acts solely as a reservation centre bringing guests and owners together. We assume no liability for the maintenance and condition or for any problems that occur while guests occupy the villa of their choice. All property information has been provided by the respective property owners and no liability is assumed by ‘the company’ for any misrepresentation of the property material or information provided. Any and all refunds or claims must be addressed directly with the ‘the company’ of which will investigate the matter within our resolution centre.  The Company endeavours to ensure the accuracy of all information provided and the quality and facilities of the villas.

As the Company acts only as a booking agent, it accepts no liability whatsoever for :
  1. any aspect of the arrangements

  2. any loss, personal injury/illness or death however incurred

  3. any problems that occur while guests occupy the villa of their choice.
Property Check-in / Check-out times:

Unless alternative times are agreed with us prior to your arrival date, access to properties will be after 12pm on the day of arrival to allow time for cleaning and servicing and the villa must be vacated by 10.00 am on the day of departure.

Payments:

A deposit payment for all properties and products including any promotional offers is required at the time of booking regardless of the product arrangements being confirmed.  In the event that the Company is unable to obtain final confirmation of availability for the selected property a full refund of the amount paid will be made.  The Company will not accept responsibility for cash sent through the post.  Payment can be made by bank transfer to our bank account or by Visa/Mastercard or additional payment methods accepted through our online booking system. Confirmation together with all relevant information for the villa will be sent by e-mail or, if requested, by fax or post.  Where an initial deposit is paid, the balance must be paid on seven days prior to arrival at the property – along with any other agreed additional payments (e.g. air conditioning costs).  For the majority of villas we accept balance payment by card adding a 2% admin fee in this amount.

Cancellation by you:

You, or any member of your party, may cancel your booking at any time.  However no refund will be made for any monies paid.  In certain cases any loss, if incurred involuntarily, may be recovered by insurance that you may have taken out. Therefore, Travel Insurance is strongly recommended.

Cancellation by the property owner/s:

The Company reserves the right to withdraw or cancel the booking.  In this unlikely event you will be offered the choice of :
  1. an alternative property through the Company (subject to availability) with the price difference payable/refundable as appropriate, or

  2. a full refund of all monies paid to the Villa Owner(s)

    No compensation is payable by the Company.
Baby Cots and Extra Beds:

Most of our properties can provide one baby cot and/or one extra bed.  Please check with us should this be required.  It should be noted that the extra bed would be of the folding 'camp bed' style and therefore may only be suitable for a child.  Baby cots are usually of the portable 'travel cot' style.

Air-Conditioning:

Whether the cost of any air-conditioning is included in the villa price, or paid for as a supplement, the units must only be used whilst you are in the property, with all windows and doors kept closed.  Under no circumstances must the units be left on continuously while the property is unoccupied.  For properties where air-conditioning is payable as an additional cost and you choose to use this facility, this additional cost must be paid for at the advertised rate which is not negotiable. Units are situated throughout the properties as described on the web-site for each property.

Building Work:

Any building work which may commence in the local area, is outside our control and we cannot be held responsible for any resulting disturbance.  However, should we become aware of any building work which may reasonably be considered to adversely affect the enjoyment of your holiday we will notify you as soon as possible, and wherever possible, will offer you the opportunity to transfer to an alternative property at the advertised price.  Whilst we assure you of our best endeavours to minimize any inconvenience we regret that we cannot accept any liability in this circumstance.

Behaviour:

It is your responsibility to ensure that you and the members of your party do not behave in any way which causes offence or danger to others or which risks damage to property belonging to others.  In such circumstances the property owner(s) and the Company have the right to terminate arrangements made on your behalf, in which case the Company's responsibility to you ceases with immediate effect and there will be no refunds, payment of compensation or reimbursement of any costs or expenses which you may incur as a result.  Furthermore, you will be liable to reimburse the Company for any expenses whatsoever which have been incurred as a result of your behaviour.

Breakages and Cleanliness:

Our accommodation is made available for letting on the understanding that the property will be left clean and tidy at the time of checkout and all personal waste must be removed from the property.  It is not our policy to take any security deposit - however the customer will be held responsible for any damage or breakages to the property, caused by the customer and in the event of such occurrence, the incident must be reported to the property owner(s) or their representative immediately and appropriate compensation made.  Customers are not permitted to move any furniture or equipment without prior written consent from ourselves or the property owner(s).  In the event of such permission being granted, it is the customer’s responsibility to return the same to its original position before checkout.  Under no circumstances must any property for use inside the property, be moved outside.

Complaints:

Once a property has been booked and paid for in full, the property owner/manager's details will be provided and thereafter guests will be liaising directly with the property owner(s)/manager upon arrival at their property.  In the unlikely event of a problem with your property occurring, whilst you are abroad, you must inform the property owner(s)/manager so that the matter can be put right.  If the property owner(s)/manager cannot resolve the problem to your satisfaction at the time, you may contact our Company's Office in Cyprus on the telephone numbers provided within our website,  so that the Company is given the opportunity to try to assist.  All claims must be addressed directly to the property owner(s).

Alterations by the Company:

Although the Company makes every effort to ensure that advertised descriptions are correct, it does not own any of the property and therefore cannot control or prevent changes.  Although changes to property advertised are infrequent, the Company reserves the right to change the description of any property or service at any time, in which case we will endeavour to notify you of all changes before commencement of the booking date, if it is practical to do so. No compensation will be payable by the Company in such cases and no claims will be accepted for costs or additional expenses incurred as a result of any changes.

Payment

Payment for the properties must be made in (€) Euro at the times specified within the booking system. Bookings will not be confirmed until such time as the deposit required has been received by the company in full. Additionally full payment of the balance amount must be made before access to the property will be granted.

Proceeding with a booking through our website states that you have read and understood these terms and conditions in full and the company or property owner accepts no liability thereafter if for any reason your understanding of the information provided is flawed. It is your responsibility to ensure that you have complete understanding of our terms and conditions and additional information and policies provided throughout our website.
